North Carolina Bad Faith Insurance Lawyers
Is the Insurance Company Cheating You?
If you were injured in a car accident, the insurance companies have a vested interest in limiting your settlement. When insurers cross the line, rejecting or low-balling legitimate claims, Maynard & Harris Attorneys at Law, PLLC, can help you fight back.
Our trial lawyers handle bad faith insurance litigation on behalf of policy holders in Winston-Salem and surrounding counties of North Carolina. Contact us today for a free case evaluation if you believe your claim was unfairly rejected.
Bad Faith Insurance Denial (Unfair and Deceptive Claims Practices)
"Bad faith" is a general term used to describe wrongfully denied insurance claims. Technically, bad faith denial is a separate tort that requires proof of outrageous, systematic insurance fraud. Most of our cases are actually brought under North Carolina's Unfair and Deceptive Trade Practices statute. They usually involve decisions and actions by a claims adjuster or claims supervisor:
- Claims flatly rejected without a justifiable reason
- Very low settlement offers
- Denying the whole claim on a minor technicality
- Disqualifying claimants because of errors on their initial application for coverage
- Denying coverage because a premium payment was missed
- Refusing to pay the policy limits
- Refusal to stack UM/UIM coverage
- Unreasonable delays to "investigate" your claim
Compensation for Unfair Claims Practices
By filing a bad faith/unfair practices lawsuit, we may prompt the insurance company to pay the full claim to avoid litigation. If a settlement is not possible, Maynard & Harris is fully prepared to go to trial. Under North Carolina law, you may be entitled to treble damages (three times what your original claim is worth) and possibly attorney fees if we prove that the insurance company or its adjusters acted in bad faith.
Attorney Douglas Maynard is a former insurance adjuster himself, and he is familiar with the many ways that insurance companies try to deny or devalue valid claims. He is an experienced trial lawyer who can hold insurers to their obligations and make them pay punitive damages for bad faith denials.
We mostly handle insurance disputes stemming from car accidents (including those that involve uninsured motorist/underinsured motorist coverage), but we have also brought bad faith/unfair practices claims relating to health insurance, life insurance and disability insurance.
